MUMBAI: Observing that the accused, a 38-year-old woman YouTuber, had touched the private parts of her friend’s five-year-old “adopted son” with sexual intent under the guise of making dance videos, a special Pocso court earlier this week rejected her bail plea. The child’s “adoptive mother” too is an accused in the case and is in jail.
Special Pocso judge saw the video in court. The judge refuted the woman’s defence that she was just lifting the child and swinging him.
“The expression of the survivor is uneasiness, attempt to come out of her hands is self-explanatory. On release, child touches his private part as he was affected. This shows that there was sexual intent in her act. There is no necessity of undressing the child for committing this act. She has committed this act while making live video which she uploaded…,” the special judge said.
A doctor who is the child’s “adoptive sister” and biological daughter of one of the accused had complained to the police. She told the court that the adoption is illegal as the child was picked up from a beggar by making no deed of adoption. The doctor alleged that the two accused friends are misusing minor children. She alleged that the YouTuber was also molesting other kids.
“It is seen that the accused does not regret for her act when objection was taken by the complainant. There is misuse of social media by the present applicant and she is having sexual intent in touching private part of the minor children under the guise of making video under her name,” the judge said.
A chargesheet was submitted against the women this week for offences under Pocso Act and Information Technology Act.
It was alleged that on December 31, 2021, the accused uploaded an almost-hour-long video. In one the clips, with a Hindi song playing, she can be seeing lifting the boy in such a manner that one her hands was fully placed on the private parts of the child. It was alleged that the child was uncomfortable and also showed irritation due to pain and tried to escape from her yelling. The accused also made several other videos and in another video she was seen using sexual and abusive words. She also claimed that nobody could stop her from “giving directions to the children”.
Rejecting the bail plea, the judge said, “In my view, boldly pressing private part of minor boy in guise of dancing on live video and having no remorse… using abusive words to one who objects shows that accused being lady is not bothered of anyone… I do not find it fit and proper to grant bail.”
