Bombay High Court denies Kangana Ranaut’s request for CBFC certificate for ‘Emergency’ film | – Times of India

Kangana Ranaut and the makers of ‘Emergency‘, filed a petition in the Bombay High Court on Wednesday, seeking the official certification from the Central Board of Film Certification. However the division bench of Justices B P Colabawalla and Firdosh Pooniwalla, has turned down the same, urging the CBFC to consider the objections. Sr Adv Venkatesh Dhond was representing the movie in court.
According to Live Law, the Bench in its order stated, “Mr Dhond for the makers of the film, submitted that the MP High Court hasn’t gone into the issue of whether the certificate has been issued or not.Thus, there will be no impediment for this Court to direct the CBFC to issue the certificate. Though there may be some substance in the argument but we are unable to pass this direction in light of the fact that the MP High Court has specifically directed the CBFC to consider the representations of the Jabalpur Sikh Sangat before certifying the film. If we were to direct the CBFC to issue the certificate, we would have breached the division bench’s directive. Judicial Propriety demands such orders ought not be passed. We therefore, are unable to direct the CBFC to issue the certificate as sought by the petitioner. We however, do not dispose of the present petition. And we direct the CBFC to consider the objections, if any.”
The CBFC was directed to decide any objections or representations, on or before September 13 and the matter was kept for further hearing on September 18. Advocate Abhinav Chandrachud, who was representing the Central Board of Film Certification (CBFC) and requested the court for extra time with the upcoming festival of Ganpati, but the same was turned down.
Directed by Kangana Ranaut, ‘Emergency’ features the actress in the lead role of former Prime Minister of India, India Gandhi. The film was all set to hit the screens on September 6 but has been postponed due to delay in receiving a censor certificate.
