The purpose of this rule, announced by the Department of Homeland Security (DHS), is to provide greater convenience to employers and workers by modernizing it for special positions and nonprofit and government research organizations. A government statement said that this change will help American companies make appointments according to their needs and remain competitive in the global market. According to DHS, this rule also provides some flexibility for F-1 visa holders who want to convert their visa to H-1B.
According to DHS, this rule will provide flexibility to students holding F-1 visas who wish to change their status to H-1B. This will help US Citizenship and Immigration Services (USCIS) speed up the processing of applications from most individuals who were previously approved for H1-B visas.

The new rules will come into force from 17 January 2025. All visa petitions thereafter will require the nonimmigrant worker to file a new version of Form I-129.
