Chief Justice of India BR Gavai on Monday, October 27, recommended the name of senior Justice Surya Kant Sharma as his successor. After getting approval from the Centre, Justice Surya Kant Sharma will become the 53rd Chief Justice (CJI) of the country. He is currently a senior judge of the Supreme Court.
The tradition is that the sitting CJI recommends the name of his successor only when he is asked to do so by the Law Ministry. The tenure of current CJI Gavai ends on November 23. After him, Justice Surya Kant will take oath as CJI on 24 November. Supreme Court judges retire at the age of 65.
Saw the city for the first time in 10th board
Justice Surya Kant’s journey started from Petwad, an unknown village in Hisar, Haryana. His father was a teacher. Till 8th, he studied in a village school, where there was not even a bench to sit. He saw the city for the first time when he went to Hansi, a small town in Hisar, to appear for his 10th board exams.
Controversy over the appointment of Chief Justice of Himachal High Court
Justice Surya Kant’s appointment as Chief Justice of Himachal Pradesh High Court was controversial. In fact, there is a consultant in the Supreme Court Collegium i.e. Consultative Judge Justice A. Of. Goyal had expressed disagreement over his appointment. Generally, while considering the promotion of a justice, the Collegium takes the opinion of a consulting judge familiar with that High Court.
Despite this, the Collegium approved his appointment and Justice Surya Kant was made the Chief Justice of Himachal Pradesh High Court on October 5, 2018. On this, retired Justice A. Of. Goyal had also shared a letter expressing strong objection against Justice Surya Kant. Meanwhile, in 2019, the Collegium also promoted Justice Surya Kant to the Supreme Court.
First to become CJI will be haryanvi
Justice Surya Kant will be the first person from Haryana to reach the top post of Indian Judiciary. Recommending his name, CJI Gavai said that Justice Surya Kant is suitable and capable to take charge of the Supreme Court.
Involved in more than 1,000 decisions including Article 370
Supreme Court Justice Surya Kant has been a part of many constitutional benches. During his tenure, he was involved in more than 1000 judgments covering matters related to constitutional, human rights and administrative law.
Memorable decisions of Justice Surya Kant
- Was part of the full bench of the Punjab and Haryana High Court that sentenced Gurmeet Ram Rahim Singh to jail in rape cases in 2017. After the violence, orders were also given to completely clean Dera Sacha Sauda.
- Justice Surya Kant was part of the bench that kept the colonial era sedition law in abeyance. It was also directed that no new FIR should be registered under this till the review by the government.
- Justice Surya Kant has also given instructions to reserve one-third seats for women in bar associations including the Supreme Court Bar Association.
- He was part of the bench hearing the Pegasus spyware case, which formed a panel of cyber experts to investigate allegations of illegal surveillance. He had also said that there cannot be free rein under the guise of national security.
