The Motor Accident Claims Tribunal (MACT), Mohali, Punjab, has ordered a compensation of Rs 84.23 lakh to the family of a head constable who lost his life in a road accident. The car had valid insurance at the time of the accident, so both the insurance company and the car driver were jointly insured.

According to the information, on April 14, Head Constable Yusuf Masih was going on foot towards Sohana Gurudwara in Mohali. At around 6 pm, a speeding car hit him. Due to serious injuries, he was taken to Sohana Hospital, where doctors declared him brought dead.

The family had demanded compensation of Rs 2 crore

The deceased’s wife Rekha Rani along with her children Johnson Sabharwal and Sakshi had filed a petition in the tribunal demanding compensation of Rs 2 crore. She gave a statement in the court that her husband was a head constable in Punjab Police and earned Rs 90 thousand every month. Rekha Rani said that her husband was the only earning member of the family and due to his death the entire family is in financial crisis.

Insurance company and car driver will give compensation

The insurance company and the car driver opposed the compensation, arguing that the accident occurred due to the negligence of the deceased. However, the tribunal, after hearing arguments from both sides, ruled that the accident occurred due to the careless driving of the car driver. The car had valid insurance at the time of the accident, so both the insurance company and the car driver are jointly responsible for paying compensation.

Assessment of income of the deceased

The tribunal estimated the annual income of the deceased at Rs 9,72,571 and determined an increase of 30% in future income. On the basis of this, an order was given to pay compensation of Rs 84.23 lakh to the family.
