The CBI on Friday filed an appeal in the Calcutta High Court seeking the death penalty for Sanjay Roy, accused in the RG Kar Hospital rape-murder case. A division bench headed by Justice Debangsu Bask said it will hear the CBI’s plea on January 27, seeking to accept the plea of the West Bengal government along with a similar plea.
The Central Bureau of Investigation (CBI) moved a bench also comprising Justice Mohammad Shabar Rashidi to hear its appeal on the trial court’s claim of invalidity of the sentence awarded to Roy. Representing the CBI, Deputy Solicitor General Rajdeep Majumdar said the central agency investigating the case has the right to challenge the lower court’s order before the higher court on grounds of invalidity of the sentence.
A court in Sealdah had on January 20 sentenced Roy to life imprisonment for the rape and murder of an on-duty doctor at Argikar Medical College and Hospital on August 9, 2024. The division bench on Wednesday said it will hear the CBI, the victim’s family and the accused through their lawyers before deciding on the admission of the appeal filed by the state government.
Seeking capital punishment for Roy, state advocate general Kishore Dutta had said before the court that life imprisonment to death for the accused was insufficient. –News-Patiala
