Government of India won legal battle against Elon Musk’s company, know what is the whole matter



In a legal battle, the Government of India has won against Elon Musk’s company X (East Twitter). In a case against the order to remove the content, the Karnataka High Court said that no foreign company like X has constitutional right to freedom of expression under Indian law. The court said that this right is only for Indian citizens and foreign companies cannot be exempted under it.

What was the matter?

In March this year, X had approached the Karnataka High Court while sueing the government. The X said that the government is ordering it to remove some accounts and social media posts through its cooperation portal. Describing the cooperation as a censorship portal, X argued that the process of removal of content or post is not transparent and it is a violation of free speech. In this case, the High Court gave a verdict in favor of the government and said that X has no constitutional right in India.

The Karnataka High Court, while giving the verdict in the trial, said that Article 19 of the Indian Constitution gives only rights to citizens. Under this, the petitioner seeking relief should be a citizen of India. If he is not a citizen of India, then this article cannot be availed.

What is the cooperation portal?

The government launched a cooperation portal to make the process of removing objectionable content from different social media platforms. Many companies including Google, LinkedIn, Microsoft, Meta and Sharechat are currently using this portal. Let us know that orders to remove posts or content from social media have been in constant controversies.
